1. Purpose
These Terms of Use (the "Terms") govern access to and use of the Korvus service, a platform for detecting technical anomalies and calculating financial impact for e-commerce websites, published by the publisher identified in the legal notice. Use of the service implies unreserved acceptance of these Terms.
2. Description of the service
Korvus provides a JavaScript snippet to be installed on the client's website and a web platform (app.korvus.fr) that continuously detects technical and conversion anomalies, calculates their estimated financial impact, and notifies the client by email or Slack. The data collected is described in detail in the public documentation.
3. Access to the service and account creation
Access to the service requires creating an account. The user warrants the accuracy of the information provided at registration and undertakes to keep their login credentials confidential. The service is available 24/7, subject to maintenance operations or cases of force majeure.
4. Commitment
The Korvus subscription is taken out for a fixed term of twelve (12) months from the account activation date. This term corresponds to the full business cycle required to learn the website's behavior, calibrate the detection models and validate them over peak periods (sales, back-to-school, year-end). No free trial is offered beforehand.
At the end of this period, the subscription is tacitly renewed for successive twelve (12) month periods, unless terminated under the conditions set out in Article 9.
5. Subscription and payment
The subscription is taken out for twelve (12) months in accordance with Article 4 and paid in monthly installments payable in advance, at the rate corresponding to the subscribed session volume. The applicable rate is the one set out in the commercial proposal accepted by the client at subscription.
The payment method is agreed at subscription. The client receives an electronic invoice at each due date.
6. Client obligations
The client undertakes to deploy the Korvus snippet only on websites of which it is the legitimate publisher or for which it holds an installation mandate. The client is responsible for informing the visitors of its website of the presence of Korvus and of their right to object (see the privacy policy).
7. Data and confidentiality
Korvus acts as a processor within the meaning of Article 28 of the GDPR for the data collected via the snippet on clients' websites. The list of sub-processors is published on the dedicated page. The processing of personal data is detailed in our privacy policy. The data collected by the snippet on client websites is hosted in France and is not transferred outside the European Union. The separate SaaS usage telemetry is processed by PostHog Cloud EU under the conditions described in that policy.
8. Liability
Korvus implements the means necessary to ensure the proper operation of the service. Financial impact calculations are estimates based on the available data and do not constitute financial, accounting or legal advice. The publisher cannot be held liable for any loss of revenue resulting from an undetected anomaly, a delayed notification or a misinterpretation of alerts.
9. Termination
The subscription may be terminated at the end of its term, subject to thirty (30) days' notice before the end of the current twelve (12) month period. Termination is carried out from the account settings or by email to [email protected]. Failing termination within this period, the subscription is tacitly renewed in accordance with Article 4.
Termination takes effect at the end of the current twelve-month period. The installments corresponding to this period remain due, and no amount is refundable on a pro rata basis. Account data is retained for the periods indicated in the privacy policy.
10. Governing law
These Terms are governed by French law. Failing an amicable resolution, any dispute relating to their formation, interpretation or performance shall fall under the exclusive jurisdiction of the competent French courts.
